Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of Caliu, a note-taking application available at web.caliuapp.com and through native apps (collectively, the “Service”). The Service is operated by Marc Torrelles, an individual based in Spain (“we”, “us”, “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use Caliu. By using the Service, you represent that you meet this age requirement.

3. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when registering and keep it up to date.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at hola@caliuapp.com if you suspect unauthorized access to your account.

4. Your Content

You retain full ownership of all content you create in Caliu (notes, tags, attachments, etc.). We do not claim any intellectual property rights over your content.

By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of operating and providing the Service (e.g., syncing notes across your devices, generating backlinks).

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Store or transmit content that infringes the intellectual property rights of others.
• Distribute malware, viruses, or other harmful software.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Use the Service for bulk storage of non-note content (e.g., using Caliu as a general-purpose file hosting service).
• Abuse the API with excessive requests that degrade the service for others.
• Use the Service for any illegal, harmful, or fraudulent activity.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Service Availability

Caliu is a local-first application — your notes are stored on your device and remain accessible offline. However, cloud sync, sharing, and other online features depend on our servers. We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect the Service.

7. Free and Paid Plans

The core Service is currently offered free of charge. We may introduce paid plans in the future. If we do, existing free features will remain free. We will notify you in advance of any pricing changes that affect your usage.

8. API Access

Access to the Caliu API is subject to these Terms. API keys are personal and non-transferable. We may impose rate limits or usage quotas. Abuse of the API may result in throttling or revocation of access.

9. Intellectual Property

The Caliu name, logo, website, applications, and all related software and design are the property of Marc Torrelles. Nothing in these Terms grants you a right to use our trademarks or branding without prior written consent.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Caliu and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of the Service.

Our total aggregate liability for any claims relating to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim (or €100, whichever is greater). This does not affect your statutory rights as a consumer under EU law.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not affect your statutory rights as a consumer under EU law.

13. Account Termination

• You may delete your account at any time by contacting us at hola@caliuapp.com.
• We may suspend or terminate your account if you violate these Terms, with notice where reasonably possible.
• Upon termination, your data will be deleted in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the app at least 30 days before the changes take effect. Continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Spain. If you are a consumer resident in the EU, you also have the right to bring proceedings in the courts of your country of residence and may use the EU Online Dispute Resolution platform.
